1. Acceptance of Terms

By accessing CaelumOS, you confirm that you:

• Are at least 18 years old or the age of majority in your jurisdiction
• Have the legal capacity to enter into binding contracts
• Are not prohibited from using the Service under any applicable laws
• Agree to comply with all local, state, national, and international laws

3. Account Responsibilities

3.1 Account Security

• You are responsible for maintaining the confidentiality of your password
• You must notify us immediately of any unauthorized access
• You are liable for all activities under your account
• Sharing accounts is prohibited and may result in termination

3.2 Prohibited Activities

You may NOT:

• Manipulate the reputation/integrity system or leaderboards
• Upload malicious code, viruses, or harmful content
• Scrape, crawl, or reverse-engineer the Platform
• Resell, sublicense, or redistribute Platform features
• Use automated bots or scripts without written permission
• Impersonate other users or CaelumOS staff
• Share or distribute copyrighted strategies/indicators without permission
• Engage in market manipulation schemes or pump-and-dump coordination

4. Subscriptions, Payments & Credits

4.1 Pricing & Billing

• Subscription tiers: Free, Quant, Whale (pricing displayed on website)
• Credits are non-transferable virtual currency for AI features
• Prices may change with 30 days notice to existing subscribers
• Billing cycles are monthly unless otherwise specified

4.2 Payment Methods

• Cryptocurrency: Payments processed via NOWPayments (300+ coins supported)
• Payments are final once blockchain confirmation is received
• You are responsible for blockchain transaction fees

4.3 Refunds & Cancellations

• 14-Day Money-Back Guarantee: First-time subscribers only (one-time use per user)
• Crypto Payments: Non-refundable due to blockchain immutability (except where legally required)
• Credits: Unused credits expire upon account cancellation or downgrade
• Cancellation: Cancel anytime via Settings → Subscription. Access continues until end of billing period.
• Refund Process: Email support@caelumos.trade with order ID. Refunds processed within 5-10 business days.

4.4 Free Tier Limitations

• 5 credits per day (resets at midnight UTC)
• Limited access to premium features (simulator scenarios, advanced AI)
• Subject to rate limiting and capacity restrictions

5. Integrity & Reputation System

CaelumOS uses a "Reputation Score" to incentivize honest journaling and verified performance tracking.

5.1 Earning Reputation

• Upload verified trade screenshots (must match broker data)
• Complete challenges with verifiable results
• Maintain consistent journaling streaks

5.2 Violations & Penalties

Manipulation of the reputation system includes:

• Uploading fake/photoshopped trade screenshots
• Creating multiple accounts to farm reputation
• Exploiting bugs to artificially inflate scores

Penalties:

• First Offense: Reputation reset to zero + 30-day challenge ban
• Second Offense: Permanent challenge ban + account review
• Third Offense: Permanent account termination

6. Intellectual Property

6.1 CaelumOS Ownership

All Platform code, design, logos, trademarks, AI models, and content are owned by CaelumOS. You may NOT copy, modify, or redistribute without written permission.

6.2 Your Content

• You retain ownership of journal entries, trade data, and uploaded images
• You grant CaelumOS a license to process your data to provide services (AI analysis, backups)
• We may use anonymized, aggregated data for analytics and product improvement
• We will NOT sell your personal trading data to third parties

6.3 AI-Generated Content

• AI-generated Pine Scripts, analysis, and insights are provided "as-is"
• You may use AI output for personal trading, but CaelumOS claims no ownership
• Do NOT redistribute AI-generated strategies commercially without verification

8. Service Availability & Modifications

• We strive for 99.9% uptime but do NOT guarantee uninterrupted service
• We may modify, suspend, or discontinue features at any time
• Scheduled maintenance will be announced 24 hours in advance when possible
• Emergency outages (security incidents, infrastructure failures) may occur without notice

9. Termination

9.1 Your Right to Terminate

You may close your account anytime via Settings → Account → Delete Account. Data deletion occurs within 30 days per GDPR.

9.2 Our Right to Terminate

We may suspend or terminate your account immediately if you:

• Violate these Terms (especially Section 3.2 Prohibited Activities)
• Engage in fraudulent payment activity
• Abuse support staff or other users
• Pose a security risk to the Platform

No refunds will be issued for accounts terminated for Terms violations.

10. Dispute Resolution & Governing Law

10.1 Governing Law

These Terms are governed by the laws of the Federal Republic of Nigeria, without regard to conflict of law principles.

10.2 Dispute Process

1. First, contact support@caelumos.trade to resolve informally
2. If unresolved within 30 days, disputes will be submitted to the competent courts of Nigeria
3. All proceedings will be conducted in English

10.3 Exceptions

Either party may seek injunctive relief in court for intellectual property violations or data breaches.

11. Privacy & Data Protection

Your use of CaelumOS is also governed by our Privacy Policy, which explains how we collect, use, and protect your data under GDPR and CCPA.

12. Changes to Terms

We may update these Terms at any time. Material changes will be notified via:

• Email to your registered address
• In-app notification banner
• Update to "Last Modified" date at top of this page

Continued use after changes constitutes acceptance. If you disagree, discontinue use and close your account.

13. Miscellaneous

• Severability: If any provision is deemed unenforceable, the remaining Terms remain in effect
• No Waiver: Failure to enforce a provision does not waive our right to enforce it later
• Assignment: You may NOT transfer your account. We may assign these Terms to a successor entity
• Force Majeure: We are not liable for delays due to events beyond our control (natural disasters, war, cyberattacks)
